
First of all, an object containing a property should be photographed and mapped and there should be a legally-binding building license and Certificate of Occupancy on the investor’s name who built the object. A verified original Purchase contract is required for a current owner to prove the ownership. This means that if there is no information whether the property, which is the object of Purchase contract, has or has not been registered, the first step should be cadaster crosscheck at Republic Geodetic Authority.
If the property is not registered, the question should be: Why? If an entire object is not registered, e.g. a building, it is required to register it first, which should be an investor’s duty. It is impossible to expect a property owner to possess documentation prior the purchase, especially if we refer to 30, 40, 50 year-old buildings that are still not registered due to unsystematic municipalities or company – investors who are the right holders. If all conditions are fulfilled, a request containing required enclosures and registration fee document shall be a prerequisite.
